2. Pre-loved products
Most items are pre-loved and each piece is sold individually. We will describe the brand, size, colour, condition and any known material flaw as accurately as reasonably possible. Normal signs of age or previous wear will be assessed in the context of the item’s description, age and price.
Screen settings and lighting can affect how colours appear. Measurements are approximate unless the listing says otherwise. Customers should read the full description and review all available images before ordering.
Fit-Check Seven checks each item for authenticity using the information and evidence available to it. Unless a listing states otherwise, Fit-Check Seven is not affiliated with or endorsed by the original brand owner.
3. Orders & contract
- The checkout will show the products, total price, delivery charge and delivery options before payment.
- Placing an order is an offer to buy. An automatic acknowledgement means the order has been received; it does not by itself mean the order has been accepted.
- The contract is formed when Fit-Check Seven sends an acceptance or dispatch confirmation, whichever is stated in the final checkout wording.
- Customers must check and correct their order details before submitting payment.
Because most pieces are unique, an item may occasionally become unavailable before an order is accepted. If this happens, the customer will be told promptly and any payment taken will be refunded in full.
Orders may be refused where payment is not authorised, delivery information is incomplete, fraud is suspected, or accepting the order would be unlawful.
4. Prices & payment
Prices will be shown in pounds sterling and will include any taxes that must be included. Any unavoidable delivery charge or other mandatory charge will be disclosed clearly before the customer commits to pay. Optional extras will never be pre-selected.
Payments are expected to be processed securely by Stripe when checkout is added. Fit-Check Seven will not store complete payment-card details. The payment methods accepted will be shown at checkout.
If a pricing error is obvious and could reasonably have been recognised as an error, Fit-Check Seven may contact the customer before accepting the order to offer the correct price or cancel and refund the order.
5. Delivery
Available delivery methods, charges and estimated timings will be shown before an order is placed and confirmed after purchase. Unless a different period is agreed, goods will be delivered without undue delay and no later than 30 days after the contract is made.
The customer is responsible for providing a complete and accurate delivery address. Risk in the goods passes to the customer when the goods are delivered to the customer, or to a person identified by them to receive the delivery. Ownership passes when full payment has been received.
The client must confirm the delivery areas, carriers, prices, dispatch times and lost-parcel process before launch.
6. Cancellations, returns & faults
Online customers normally have a statutory right to cancel an order without giving a reason. The time limits, refund method, return costs and model cancellation form are set out in the Returns & refunds policy.
Goods must be as described, of satisfactory quality and fit for purpose. These standards apply to pre-loved goods while taking account of their description, age, condition and price. A disclosed imperfection does not remove rights relating to a different fault or misleading description.
Nothing in these terms excludes the customer’s rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
7. Our responsibility
Fit-Check Seven is responsible for loss or damage that is a foreseeable result of breaching the contract or failing to use reasonable care and skill. It is not responsible for loss that was not foreseeable when the contract was made.
Products are supplied for private use. Fit-Check Seven is not responsible for business loss arising from consumer use of a product. Nothing limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or a consumer’s statutory rights.
8. General terms
Events outside reasonable control
If delivery is delayed by an event outside reasonable control, the customer will be contacted as soon as practicable. The customer may have a right to end the contract if there is a substantial delay.
Personal information
Personal information is handled as described in the Privacy & cookies notice.
Changes and severability
The terms in force when an order is placed apply to that order. If a court finds one term unenforceable, the remaining terms continue to apply.
Law and disputes
These terms are governed by the law of England and Wales. A consumer may bring proceedings in the courts that apply where they live. Customers are encouraged to contact Fit-Check Seven first so a complaint can be considered promptly.
